  • Complying with TCPA, CTIA guidelines, carrier requirements, and privacy regulations
  • Ensuring uploaded contacts may legally receive communications

Message delivery is not guaranteed and may be impacted by:

  • Network interruptions
  • Third-party service limitations

Standard message and data rates may apply to recipients based on their wireless carrier plans.

Welcome to TruAfterCare.com (“TruAfterCare,” “we,” “our,” or “us”). By accessing or using our website, platform, or services (collectively, the “Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

1. Service Overview

TruAfterCare is an automated aftercare communication platform designed specifically for funeral homes to provide thoughtful, compassionate follow-up communication with families after services have been rendered.

The platform is intended to strengthen family relationships, enhance aftercare support, and provide an optional avenue for feedback and review engagement.

TruAfterCare is not intended for:

  • Mass marketing
  • Promotional text blasting
  • Political solicitation
  • Fundraising campaigns
  • Spam or unsolicited outreach
  • Advertising unrelated products or services

Unless otherwise customized and approved, the platform is generally limited to a maximum of seven (7) automated text communications per family over a twelve (12) month period.

2. Funeral Home Responsibilities

By subscribing to or using TruAfterCare, the funeral home agrees to:

  • Use the Service solely for communication with families and contacts with whom they have an existing business relationship
  • Ensure all uploaded contact information has been lawfully obtained
  • Ensure recipients may legally receive communications
  • Maintain compliance with all applicable federal, state, and local laws governing communications and privacy
  • Comply with TCPA requirements, CTIA guidelines, carrier rules, and applicable privacy laws
  • Review all customized message content for compliance, professionalism, and appropriateness
  • Assume full responsibility for any custom messaging content modified from TruAfterCare templates
  • Maintain accurate business contact information, website links, review links, and response email addresses
  • Promptly monitor and appropriately respond to recipient replies when notification forwarding features are enabled
  • Maintain the confidentiality of login credentials and account access

The funeral home agrees not to use the Service to send communications containing:

  • Vulgar or offensive language
  • Discriminatory or harassing content
  • Misleading or deceptive information
  • Political messaging
  • Spam or mass marketing communications
  • Illegal or infringing material
  • Content unrelated to compassionate aftercare communication

Any misuse of the platform may result in immediate suspension or termination of service.

3. TruAfterCare Responsibilities

TruAfterCare agrees to:

  • Provide access to the platform during the active subscription period
  • Maintain reasonable operational functionality and uptime
  • Deliver scheduled automated communications according to the selected messaging cadence
  • Provide standard onboarding assistance and reasonable technical support
  • Maintain confidentiality of account information in accordance with applicable privacy practices

TruAfterCare does not guarantee uninterrupted service or message delivery. Delivery and availability may be impacted by:

  • Wireless carrier restrictions
  • Network interruptions
  • Recipient device settings
  • Blocked numbers
  • Third-party service disruptions
  • Maintenance or system updates

4. Intellectual Property

All content, software, text, graphics, logos, templates, workflows, branding, design elements, and other materials associated with TruAfterCare are owned by TruAfterCare or its licensors and are protected by intellectual property laws.

You may not reproduce, distribute, modify, reverse engineer, create derivative works from, or otherwise use any portion of the Service without prior written consent.

5. User Content & Custom Messaging

TruAfterCare may provide professionally written default messaging templates designed for respectful aftercare communication.

If a funeral home uploads, modifies, or replaces content (“User Content”):

  • The funeral home retains ownership of its content
  • The funeral home grants TruAfterCare a non-exclusive, worldwide, royalty-free license to host, process, and transmit such content as necessary to provide the Service
  • The funeral home assumes full responsibility for the modified content
  • The funeral home represents that it has all necessary rights and permissions to use such content

TruAfterCare reserves the right to reject, suspend, remove, or disable content deemed:

  • Inappropriate
  • Abusive
  • Non-compliant
  • Misleading
  • Illegal
  • Inconsistent with the intended purpose of the platform

6. Subscription Terms

TruAfterCare is provided as a subscription service.

Unless otherwise agreed in writing:

  • Subscription fees are billed annually
  • Service may be canceled with forty-five (45) days written notice
  • Refund requests are reviewed on a case-by-case basis at the sole discretion of TruAfterCare
  • Failure to pay subscription fees may result in suspension or termination of service

7. Third-Party Services

The Service may integrate with or rely upon third-party platforms, communication providers, analytics services, hosting providers, payment processors, or external websites.

TruAfterCare is not responsible for the availability, performance, policies, or practices of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, TruAfterCare disclaims all warranties, including:

  • Uninterrupted availability
  • Error-free operation
  • Guaranteed message delivery

9. Limitation of Liability

To the fullest extent permitted by law, TruAfterCare shall not be liable for any:

  • Special damages
  • Regulatory penalties
  • Reputational harm
  • Loss of profits, business, goodwill, or data

Including claims arising from:

  • Improper or unauthorized messaging
  • Compliance violations
  • Delivery failures
  • Missed responses
  • Carrier filtering or blocking
  • Third-party system failures
  • Unauthorized access by third parties

TruAfterCare’s maximum aggregate liability shall not exceed the amount paid by the customer to TruAfterCare during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless TruAfterCare, its affiliates, owners, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, penalties, costs, or expenses arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of communication or privacy laws
  • Your uploaded content or modified messaging
  • Unauthorized or unlawful communications

11. Suspension & Termination

TruAfterCare may suspend or terminate access to the Service at any time for:

  • Violation of these Terms
  • Fraudulent or abusive conduct
  • Nonpayment
  • Regulatory or compliance concerns
  • Use inconsistent with the intended purpose of the platform

You may discontinue use of the Service at any time subject to applicable subscription obligations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

13. Service Modifications

TruAfterCare reserves the right to modify or discontinue any aspect of the Service, including:
